Being Stanford University's GC is a Study in Legal Diversity

Some 20,000 undergraduate and graduate students populate Stanford University in Palo Alto, a place of swaying palms and red tile-roofed buildings. Stanford employs more than 20,000 people, making it the largest private employer in Santa Clara County, the heart of Silicon Valley. With 8,000 acres of gently rolling land, it's the county's largest landowner. Jane and Leland Stanford ? a railroad baron, he served as governor of California and U.S. senator ? founded the university in 1885 in memory of their only child, Leland Jr., who died at age 15 of typhoid fever.

LEGAL TEAM

General Counsel Debra Zumwalt oversees a dozen lawyers and provides legal support to the university, Stanford Hospital and Clinics, the Lucile Packard Children's Hospital at Stanford, the Stanford Linear Accelerator Center, the Stanford Management Co. and the university's police force and power plant. "We're like a little city in many ways," Zumwalt said. "It's one of the most diverse practices you can imagine for an in-house lawyer."

Stanford's legal department includes one attorney whose sole duty is to handle the complex government contracts that support U.S. Department of Energy funding for the linear accelerator. Stanford researchers there study particle physics and astrophysics.

Two lawyers oversee the legal issues affecting Stanford's two hospitals, which are slated for expansions worth $5 billion. The attorneys have been smoothing the path for the projects, which Zumwalt said have entailed "four years and 90 public hearings ... to get the entitlements to be able to [build] on our own land." The 150-bed children's hospital is scheduled to open in 2016. The expanded hospital and clinics will be completed in 2018.

Another attorney specializes in employment issues at the university, and one oversees such matters at the hospitals. Stanford's management company, created in 1991 to manage the university's $16.5 billion endowment and additional financial assets, has a dedicated lawyer as well. Other legal team members oversee faculty, copyright, medical school and general business matters.

OUTSIDE COUNSEL

The university outsources litigation, often to Sarah Flanagan in Pillsbury Winthrop Shaw Pittman's San Francisco office. Gordon & Rees handles employment issues. Bingham McCutchen provides advice on complex, long-term leasing issues involving Stanford's research park. Zumwalt relies on A.L. (Lorry) Spitzer in the Boston office of Ropes & Gray for advice on tax issues for nonprofits.

The legal department negotiates discounted hourly rates to keep its budget under control. "One of my mantras is that I don't like surprises," Zumwalt said. Her office negotiates flat fees with "success bonuses" for positive results. She expects her budget to remain relatively unchanged through next year. Any increases would be due to the addition of a new lawyer and higher legal costs relating to the hospitals' construction and the new health care law.

DAILY DUTIES

"A typical day is when the main thing I'm dealing with is something that wasn't on my schedule," Zumwalt said. She reports to university President John Hennessy and attends board meetings for the university's hospitals, their insurance board and Stanford's management company.

Following Pennsylvania State Univer?sity's sex abuse scandal, Zumwalt has been raising awareness about compliance issues. A grand jury has been investigating whether Penn State officials failed to act on a report that former defensive coordinator Jerry Sandusky had assaulted a boy. "What does it mean to have a culture of compliance, so that people feel responsible to speak up if they see something going on that's not right?" Zumwalt said.

Helping the legal staff connect with campus employees serves two purposes, she said: It ensures problems are solved and it familiarizes employees with the legal team. Zumwalt has been collaborating with other universities on an amicus curiae brief in a challenge before the U.S. Supreme Court to the University of Texas' affirmative action program, Fisher v. University of Texas at Austin.

IN THE NEWS

Zumwalt was Stanford's lead negotiator last year in talks with New York City to build a state-of-the-art graduate technical campus. The university was seen as a leading contender but withdrew its bid in December, citing what it considered unreasonable demands by the city. Cornell University was chosen to build the $2 billion complex, now called CornellNYC Tech.

"Stanford was being asked to be responsible and be penalized significantly for things that weren't within our control and were in fact within the city's control," Zumwalt said. "There were changes that were contrary to what had been proposed in the [request for proposal] and things being changed that had been agreed to during the negotiations.

"It was very frustrating for us," she said. "It required a true partnership to make this very complicated [project] work ? not just to get through the gate, but over the long term. And in the end, we felt we wouldn't have that partnership with the city, so we reluctantly made the decision to withdraw."

ROUTE TO THE TOP

An Arizona native, Zumwalt graduated from Arizona State University in 1976 and received her law degree from Stanford Law School three years later. She joined Pillsbury as a litigator and then became a litigator for Chevron Chemical Co. She was recruited to join Stanford's legal department in 1987. Zumwalt returned to Pillsbury in 1993 to focus on complex litigation and higher education law. She was back at Stanford in 2001, this time as acting general counsel. Zumwalt was named to the permanent position one year later, replacing Michael Roster, the university's second GC.

PERSONAL

Zumwalt's daughter, Elizabeth, 22, is a Stanford student majoring in international relations and minoring in Arabic. Zumwalt is a past president of the local bar association, is active in legal aid efforts and is vice chairwoman of the board of the American University of Afghanistan, a co-educational, nonreligious liberal arts university that serves more than 900 Afghan students. In May, she traveled more than 15 hours by plane to watch the second graduating class of 49 students receive their diplomas. The university plans to launch a law school in the fall, in partnership with Stanford.

RECENT BOOK AND MOVIE

Steve Jobs, by Walter Isaacson, and a slew of movies shown during several flights to and from Afghanistan. "Between San Francisco and Dubai, I watched three or four movies and forgot them all," she said.

Raising Asperger's Kids: Practicality: Not Becoming and Autism-Only ...

One of the major aspects of parenting a child with an autism spectrum disorder is trying to figure out how NOT to become a one-topic family. It really does not have to be all autism all the time. I make sure to tell parents that if they liked reading non-autism related books before diagnosis, keep reading these novels. If you liked to play golf, shoot hoops, needlepoint or knit then keep doing that. If you liked getting manis and pedis keep doing that. Go out with your spouse and get a cup of coffee together and don't talk about autism. If you volunteered for a charity keep helping out the needy.? Problem is, people tell me is that I can give this advice its just so much harder to put into effect...guess what ...yes it really is...

Now remember I am talking about when your child is first diagnosed, not how an adult should or would handle their own diagnosis. I am told, for many adults the diagnosis comes as a relief and they wholeheartedly embrace their autism. They throw themselves into understanding themselves by understanding everything they can about autism. I am in no way telling these adults what to do, how to feel or how to approach their autism. For them this is a very personal decision and not something anyone else (NT or autistic)? has a right to dictate.

What I am going to discuss here is how you the parent should? act and what you need to do in order for it not to be "all autism all the time." The reality is, that in the very beginning it is all autism all the time. How could it not be? When you finally get that diagnosis for your child, your instinct as the parent is to try to find ways to help your offspring. You need, you want , you are compelled to find out everything you can about autism so that you understand how to help your child. You want to "fix" everything. You want to make everything better and if not better than more manageable, less painful and confusing for your child.

So yes in the very beginning you delve not the world of autism. Your home becomes a sensory friendly environment. Your refrigerator is full of foods and drinks that you are told may be helpful. You make sure that when you go out that there will be a minimal of sensory issues. You look for "autism-friendly" movie theaters, play groups and schools. Good. This is what you are supposed to do.

But......

You also need to remember that not everything in the world is about autism and as I like to say, your child is more than autism. The child who liked to draw before diagnosis is still the child who liked to draw. The child who liked to write stories is still the child who liked to write stories. The child who liked to ride his bike or play on the jungle gym is still the same child. The child who liked to swim before diagnosis is still the same water-fish. Autism didn't give them the ability to do these things, it may make their perspectives or their ability to analyze a project different than say an typical child, but it is not the autism that gives them their talent, their drive or their gifts. Harness these gifts as gifts. Not as an outgrowth of autism.

I used to have a group of friends, all of us have children on the spectrum.? We were at one time our own little support group. Well one of these friends everytime her son did something would say it was because of the autism. When he swam it was because autistic children liked being in the water. When he listened to classical music it was because autistic children are calmed by this type of music. This attitude used to drive a third member of our group to distraction. She would tell me how much she hated that perspective. Everything that our children do is not because of autism, she would say. Honestly I think this difference, among other realities, led to the breakup of our little group. We expected more from our sons, while the autism-encapsulated-mom not only decided everything was due to autism, but autism was also a great excuse for her as well.

While you recognize that your child is still your child after diagnosis you must remember that YOU are still you after diagnosis too. Yes read as much about autism as you possibly can. Make sure you know about the laws and what programs do and do not work for a child on the spectrum. Understand medical advice and the latest technologies to help your child. Delve deeply into this world. You do have to.....but then...

1. Make sure you have a place in your house that belongs to you and you alone.
? ? ? ? ? When the boys were little and everything about the house was an autism friendly environment, my parents bought me a little black and white television for the kitchen. They told me that I needed to stay connected to the real world. Watch the news they said while I make dinner. It was the best advice. It's why I post information about other topics even on this blog from time to time. You must stay connected to the wider world.
?????????? Have a chair or an area in your bedroom for makeup, and a closet for "nicer" clothes.
?????????? Make sure that you still continue to use face cream and even a little make-up if you want.
?????????? Get your hair cut every few months,? if you can't afford a mani and pedi, then get a manicure at least once a month. Have someone wait on you for a change.Yes the husband can stay with the children for an hour or two while you do this. The hubby will survive and so will the children. Even before we knew that the boys were on the spectrum, I would leave the husband with them for several hours on a weekend day and go do something myself, even if it was only food shopping. They can handle the children and you are allowed some alone time. It's good that they truly learn to understand what your day is really like too. (Listen I understand that not everybody has a partner, but try to find someone to watch the children for a few hours a week if you can or even every other week. Many call it respite, I call it your right to be an adult.)
?????????? Find time to exercise. Even if its no more than going for a walk. Or buy a DVD and have the children do it with you while you are home. Or when they go to school instead of doing the laundry or cleaning the toilets, do some exercise. It's only 30 minutes out of the day.

2. Charity and volunteering
?????????? If you liked to volunteer for your church, synagogue, mosque, or temple before diagnosis still do. If you spent time with the Untied Way or local homeless shelter, still do. I spent time volunteering for a law group that went into schools to teach middle school students about their rights and obligations. I created seminars for my local school about the constitution and coordinated this history with the appropriate school curriculum. I created an ethics seminar for my synagogues education program (the children didn't like the class so it got scrubbed) but heck simply try and teach Sunday school.
? ? ? ? ?? If you wanted to help out with the PTA still do and don't just do it for the special education committee. I purposely did not volunteer for the special education committee while the boys were in school. I helped out as class parent, party coordinator, welcoming committee chair, publishing center support, library aide, and even treasurer of the high school PTA (that one was a hoot since I still can't balance my own checkbook.) People used to ask my why I never participated in the special ed committee and I answered truthfully, that it was important that people see our family as more than an autism family. People needed to see the boys as more than autism or us as more than just a special needs family. Remember society knows that your special needs child takes more money and more effort than a typical school child and it is nice when you can be seen as giving back to the community for something that other people's children can use...seriously a higher percentage of their tax dollars do go to help your child too...
?????????? By the way, this attitude goes for your children in the long run as well. When the boys could join after school clubs I had them join the local volunteer organizations. They helped out by collecting food for the local food bank, collecting childrens books for a local homeless shelter, making posters for? local charity events, raising awareness about the genocide in Darfur, lately they have helped a local horse therapy barn with some construction (they did not see it as an extension of their autism, this project was for Martin Luther King, Jr service day) and this summer they are interning at a local charity doing data entry and what ever else is needed. I had them help out with charity events at our synagogue when they were younger too. If your religious organization has youth groups sign your child up too.
?????????? Now I did and still am a volunteer parent advocate in my town. I am there to help parents of newly diagnosed children and to shepherd them through the education process if they want. But it is done privately with the school district. My name is not on a roster nor is my name part of the CSE committee members. My services are just offered when a parent applies for an evaluation. Listen, I said do other things besides autism or special needs, I didn't say don't help others if you can....

3. Your professional and education life
?????????? I will admit right away that I am one of those very lucky women who could chose to stay home with my children. The hubby earned enough money that we were able to give the boys what they needed. OK, I will also admit it, we have an obscene amount of debt too. But that just goes with the territory of special needs parenting I think. The issue for me was who would do a better job at raising the boys, me or a stranger. Luckily I really didn't have to think? too long about this issue. Hats off to the single-special-needs-parent or any working-parent-couple of special needs children. Coordinating that reality is something I never had to face and I am not certain what I would have done.
? ? ? ? ? ? Remember too, if you are one of those parents who goes to work, its OK to like what you do and to be away from home for awhile as well. It's just fine to think about your professional life and to care about your professional future. Don't guilt yourself. I have friends of typical children who love to work because they like having daily grown-up conversations. These people like that they inhabit two worlds and not just one. Being a special needs parents doesn't mean you can't and shouldn't feel the same.
? ? ? ? ? ? But for those of us who do stay home, another way to not becoming inundated with autism is to remember that you were trained in a profession and have some skill sets that are very important. After the boys were diagnosed I decided that I needed to continue with my professional life. I actually had never passed the Bar Exam in the state and I decided to try again. I bought an on-line study course and I coordinated my program. I studied between therapy appointments, laundry, cooking, food shopping and mommy-taxi time. I studied with two small children either sitting on my lap or sitting next to me. And yes I passed. It was something I had to do for myself. Have I ever really practiced law? I tried part-time from home, but nope it really didn't work out at all. No, sometimes you really can't have it all.
?????????? Today there is so much on-line education and professional programs that you can continue to learn and practice your skills without actually leaving home. Remember that little corner of a room for your make-up and clothes....add a computer and/or text books. Don't stop learning and don't give up what you have learned.
? ? ? ? ? ? Also telecommuting is a major part of business today. Don't just give up everything you have worked for. Talk to your boss, see what you can work out. Or start a business from home. So many moms do it, especially in today's economy. You would not seem like the odd-person out. (I know I talk a good game, but in reality I still haven't figured out a business from home. As I said, I am still trying to figure out what I want to be when I grow up.)

In truth there is alot you can do to not become an autism-only family. But this mainly depends on the time and effort you put into remaining a rounded person. It takes work to accomplish this goal. It will not happen simply because you want it to. In all honesty while your children are little, you will be more of an autism-only family. You are working on understanding and coordinating everything in their lives to set them on the right path. As they grow up and you see what they are also interested in and where their talents lay, you too can loosen the autism-strings and as they fly so can you. When you have more hours during the day to yourself, you will find that you can rediscover yourself as well.

Everything I mentioned in this post is not something I did or accomplished from the get-go. Initially as I wrote, my parents bought me a little television to stay connected to the world. That and studying and passing the bar are the two things that kept me in the wider-world. You need to understand that everything is incremental in this world and that the steps you take do not have to be huge ones either. For example: crossword puzzles. I love puzzles. For years everyday I did the New York Times crossword puzzle. That was my challenge and that was my escape, so to speak. Remember to keep yourself its the little things, not the big things that count.

This is also why I started the blog The Rediscovered Self. As an autism-parent I realized that so many of us forget ourselves and what gives us joy. We spend out lives worried and frightened for our children and what the future may hold for them. But you need to try not to live that way. Plan and coordinate as best you can. Do what you can for your children. But a depressed parent, a parent who forgets their own humanity will not be a help to their children ever.

From B is for Balance:

Balance. I would have to say that that has probably been one of the hardest aspects of life with special needs children. Oh not that you don't balance their lives. Between therapies, doctors, school, "typical" activities and just plain doing nothing, we all seem to be able to balance our children's lives. What I am concerned about when I speak to many parents of special needs children is the ability of the parent to balance their lives.

Yes, when you have a child your obligation is to make sure that that child has every advantage in the world. Yes, as parent you have the obligation to provide, nurture and support your child as they grow, develop and mature. Yes as a parent you have the obligation to ensure that your children thrive.

The problem that happens though is that we forget that we too are entitled to grow, develop and thrive along with our children. You do not cease to be a person because you are a parent. You do not cease to be a person because you are a parent of a special needs child. You do not cease to have your likes, dislikes, needs and wants as well.

This is when the balancing becomes important. You need to find the time to remember that you too are a person. Now do I speak from experience of being able to balance my life? Absolutely not. I speak from experience of NOT? being able to balance my life. I speak from experience of demoting my own importance. Read this mea culpa to see how sorely lacking I am in this regard.

Listen it is not that you relegate your obligations and the love you have for your child to the back burner when you do something for yourself. It is merely making sure that you remember your own humanity. Now what exactly am I talking about?

What I am talking about is that YOU are allowed to go with a friend to get a cup of coffee without the children just like parents of typical children do. You are allowed to have lunch, go to a movie and even have a date with your spouse. I am talking about reading a newspaper or a book that has nothing to do with autism, but may be part of a hobby that YOU love. I am talking about that it is OK to get a manicure and a haircut. It is OK to buy yourself some makeup if that makes you feel better. It is OK for you to go for walks, exercise and eat food that you enjoy, not just eating the leftovers from your child's meal. It is OK that YOU are not subsumed by your child's special needs. It is OK to still be YOU.

Y is for You

'Captain Mom' last '99 holdover for US

By JOSEPH WHITE

AP Sports Writer

Associated Press Sports

updated 3:35 p.m. ET July 29, 2012

MANCHESTER, England (AP) - She is the last remaining link to the team that put women's soccer on Page One, the U.S. squad that won the World Cup at the Rose Bowl in 1999.

She now has a different name on her jersey, although her teammates still call her by the old one. She also has two kids in tow and takes them everywhere the team goes, having inherited the unofficial role of national soccer mom.

Her other title is captain, although she's among the quieter players on the team. She's played in 262 games for her country - fourth on the all-time U.S. list - but she's not a household name like Mia, Hope, Abby, Brandi or Foudy.

Christie Rampone, all of 37 years old, runs the defense and remains in charge of the psyche of U.S. team that has qualified for the quarterfinals of the Olympic tournament. The Americans wrap up group play on Tuesday against North Korea.

"I don't talk that much. But when I speak, it means something," she said with a laugh.

Don't expect Rampone to score goals - she has only four in her international career - but she calls the shots for the back four and keeps a close eye on the pulse of a talented, personality-heavy team.

"Best captain I've ever had," coach Pia Sundhage said. "Better than I was as a captain. She leads by example, and she respects the players around her. She has the timing of saying the right thing at that right moment."

Rampone was known by her maiden name, Pearce, on the 1999 team and kept it on her jersey until 2004, three years after she was married. Her teammates to this day still call her "Pearce" and "Pearcy," a reminder of her link to the days of Mia Hamm and Co.

"It's awesome to be a part of both generations," Rampone said, "being part of that amazing team and what they stood for on and off the field, and learning from great leaders. And now just being part of this next generation and the things that they're teaching me as an older player has been fun - just to instill some of the qualities that the old team had, but yet shape the personalities of this team."

Rampone is the only mother on the team, and daughters Rylie (6) and Reece (2) are the squad's unofficial live-in groupies. During a road trip earlier this year, the team staged a "Reece race" - a tongue-in-cheek contest to determine which player was her favorite.

"She's the heart of the team, for sure," midfielder Megan Rapinoe said. "Captains are usually more outspoken and probably more of a dominate personality, but she's just kind of cool, calm and collected back there."

Rampone has been captain since 2008, but she has some help at these Olympics. Sundhage designated gabby veteran forward Abby Wambach as co-captain after last year's World Cup, although Rampone still wears the captain's armband.

"They have almost opposing styles," defender Amy LePeilbet said. "But it's a good complement because Pearcy calms us, lets us know what we need to focus on, what's important. And Abby's that energy, gets us going, that enthusiasm that comes from Abby. It's a good combination."

Rampone said she doesn't mind sharing duties with Wambach, especially if it means deferring the spotlight.

"She likes to do more of the media stuff than I do," Rampone said, "so I have her do more of the talking and I do more of the behind the scenes."

It's more of an instinct job than a regulatory one. No one will mistake the team's training camps for the NFL version, usually run by a dictatorial coach.

"I'm not a big fan to create rules. I don't have a rule," Sundhage said. "I told her if you create rules, and if you break the rules, I have to punish you. I don't like that. But there are a lot of unwritten rules, and the players come up with the unwritten rules. They make my life very easy and fun."

Well, not always. Sundhage, Rampone and Wambach had to put out a fire Sunday, meeting with Hope Solo after the outspoken goalkeeper took to Twitter to criticize former U.S. team player Brandi Chastain's NBC commentary during these Olympics.

Sundhage said Rampone was instrumental in the meeting, particularly because the coach doesn't know much about Twitter. Sundhage said Rampone has stressed the need to create a "bubble" around the team to cut down on distractions, something that was re-emphasized with Solo.

Rampone initially felt these Olympics would be her last major competition, but she's reconsidering because she's playing well and still has the speed to chase down strikers on a counterattack. There is the issue, however, of her daughters. Rylie recently started kindergarten, making it harder to take her everywhere on the road.

"The way I'm feeling, the way I'm playing, the way my body feels, I feel I can definitely do more," Rampone said. "It's just a matter of taking everything into consideration with family, travel, how much time this team is together. It's a big commitment, and it's a lot more travel than it used to be."

When the Lights Go Out: Tips for Preserving Business Continuity ...

Keeping critical workloads operational and preventing data corruption are a data center?s top priorities during power outages and it is an inconvenient reality that, sometimes, shutting down servers is the only way to meet those goals. To do this, data centers have long relied on a combination of UPSes and power protection software. However, with virtualized servers, safeguarding data during power failures can become significantly more complicated.

?

Most server virtualization software vendors offer ?live migration? products, but despite their many advantages, none include built-in functionality for responding to power outages. Furthermore, most power protection systems for virtualized server environments come with their own command console. As a result, technicians must use one tool for virtualization management and a separate one for power management. That weakens their productivity and can delay response time during utility failures.

?

These challenges can definitely become issues that impact business continuity and risk data integrity, as response time and operational efficiency are of upmost importance for protecting data during a failure. The good news is there are several ways for companies to simplify disaster recovery processes in order to fully take advantage of server virtualization?s benefits:

?

1.??? Download open source management code. Pre-written, open source operating system code for shutting down servers gracefully and in the correct sequence during power failures is being developed and distributed via websites such as Network UPS Tools. By downloading, installing and customizing such code, data center managers can equip their infrastructure to shut down servers in the proper order when utility/server power becomes unavailable. This solution offers an easy yet extremely powerful and highly configurable power management option to organizations that use and customize Linux or other open source solutions, a category that includes most operators of cloud computing data centers.

?

2.??? Add automated scripts to advanced power protection software. Many advanced power protection solutions enable users to create scripts that automatically respond to specific alarms in a predefined manner. Companies can use such scripts to augment their power protection system?s built-in functionality in sophisticated ways. For example, technicians could extend UPS battery runtime by creating a script that automatically shuts down virtual machines running non-critical workloads early in a power outage and then consolidates the remaining virtual machines onto a smaller number of host servers.

?

3.??? Deploy advanced power protection and management software.
Deploying modern power protection and management software significantly eases the complexities of keeping critical applications continuously available during power outages. Some solutions even integrate directly into the dashboards of leading virtualization management products, enabling technicians to view, monitor and administer not only physical and virtual servers but also uninterruptible power systems (UPSes) and other power devices through a single console. Consequently, these solutions can be configured with the aid of the virtualization management system to shut down both physical and virtual servers in pre-defined sequences that minimize exposure to data loss.

?

Traditionally, when a virtualized data center loses power, technicians must manually initiate the recovery process in a specific sequence, often in the face of intense time pressure. The latest software developments can increase productivity and response time by identifying the power failure immediately, initiating a backup site, and triggering disaster recovery failover and planned migration processes to maintain business continuity and data integrity when shutting down servers is unavoidable.

?

Within the span of a few years, server virtualization has progressed from promising new technology to data center mainstay. While virtualization does arm IT and facilities managers with potent new tools for maintaining business continuity during electrical failures, it also makes preserving data integrity, business continuity and brand reputation during power outages more complicated.

?

With the high costs of downtime, lacking a truly comprehensive power protection system in a virtualized environment can mean risking the availability of your essential applications, the safety of your data and the image of your business.

?

The good news is the latest in power management solutions positions companies to take full advantage of server virtualization?s rewards. Companies should therefore view advanced power management software as an essential component of doing businesses within any server virtualization environment.

Sales Training Benefits

Miscellaneous Written by Anonymous ??Saturday, 28 July 2012 20:42 Having a top functioning sales team is necessary to any business enterprise that depends on sales based profit. If your product sales experts do not work well, then your bottom line will be afflicted. As easy as it may sound, the most impressive ways to retain good sales efficiency is via Sales Traning. By educating your sales crew, you can't only improve performance but also develop some uniformity of technique across your team.

You will find both advantages and disadvantages to educating a sales staff. In many instances the advantages outweigh the minuses, but all problems should be considered. Train new salesmen in valuable and powerful sales methods. Recharge the knowledge and techniques for existing salespeople. Bring in new methods to a sales team. Keeps proper methods and procedures new. May also help build persistence in your sales process.

Then again, like we have talked about, there are some adverse facets into it. May take time far from selling actions. A new methods may contradict latest knowledge. Resistance of some sales agents to be trained something they already know. Will take time to carry out new tactics and methods. In these instances, we should be able to maintain good revenue efficiency still. A plan of on-going sales training is probably the ideal way to improve your sales process and sales usefulness.

By undertaking sales training on a regularly scheduled basis you can ensure the understanding of your staff is always strengthening. This program for training enables the continual opening of new sales strategies and lets you shift focus periodically to precise areas that require advancement. An integral element of this training course is the capacity to monitor your progress and how it is affecting your sales.

A program of on-going and prepared sales training could be a big benefit to any sales organization. If you are planning, reviewing, or setting up a system for sales training for your company always consider the subsequent issues: What are the pluses and minuses of doing the training? What areas in your sales process should be addressed or enhanced? How will you monitor your sales and the affect of the sales training? Who can attend the training? Just as with anything you do linked to your sales and sales process, training can have a significant affect. If completed in a well arranged and planned fashion, ongoing sales training can be one of the most beneficial investments for your firm.

CNN chief Jim Walton calls it quits

NEW YORK (AP) ? CNN chief Jim Walton said Friday he is quitting, saying the company needs new leadership at a time its flagship U.S. network is suffering through some of its poorest ratings ever.

Walton built the company into a profitable international news organization in his 10 years as president of CNN Worldwide, and said it is on track for record profits this year. But the U.S. network is the most visible part of the business and is now entrenched in third place behind rivals Fox News Channel and MSNBC in prime time.

He announced the decision in an email to staff members on Friday. He said he'll continue working until the end of the year during the company's search for a successor.

Walton said he's been talking to his boss, Turner Broadcasting Chairman Phil Kent, about leaving since the first few months of the year. CNN is owned by Time Warner.

"There's always pressure," he said. "I've been doing this a long time and CNN has had its ups and downs, like all companies have had ups and downs. I feel really strongly about a number of parts of this company. We're having a really strong year internationally and in mobile. It's clear there's a lot of spotlight on CNN's U.S. performance and it's reasonable that there is that spotlight."

CNN's U.S. network had its worst-ever ratings for a second quarter, down 40 percent for some of its prime-time shows. The decline was particularly notable in May, when CNN faced tough competition from broadcast networks during a slow news period and its ratings were compared to a year earlier, in the aftermath of the Osama bin Laden killing.

It hasn't improved appreciably since then, with veteran newsman Wolf Blitzer often losing in the ratings to broadcast novice Al Sharpton on MSNBC. Piers Morgan's show has been a bright spot this month.

The network was also embarrassed by initially reporting incorrectly the U.S. Supreme Court's decision on President Obama's health care law, then taking longer to correct itself than Fox, which made a similar error.

CNN's ratings traditionally fluctuate based on the intensity of the news. Fox and MSNBC have insulated themselves from that problem somewhat through its partisan prime-time hosts. Walton has resisted this approach, believing CNN's strength lies in being a nonpartisan news source and the company's reputation would be damaged worldwide if the U.S. network changed.

Walton said he doesn't expect that to change after he leaves.

"We kind of know who we are and our corporate colleagues know who we are and there has always been great support internally that we're going to be a news organization," he said.

At CNN, "we want to be accurate above all else, we want to be timely ? first if possible ? we want to actually go to where the news is, not just subscribe to some agency's news feed and talk about it. We want to report the news from multiple sides, all sides, and without bias."

Walton, 54, began working at CNN in 1981 shortly after it started. His first job involved ripping paper scripts off wire machines and operating the TelePrompter for news anchors.

CNN has suffered from weak programming and fundamental changes in the way people get their information, said Frank Sesno, a former CNN Washington bureau chief and now a professor at George Washington University. The company needs to make programming compelling enough to draw viewers used to getting their news elsewhere first online, he said.

CNN should put its attention toward other ways of delivering the news, said analyst Brad Adgate of Horizon Media.

"I don't know what they can do to catch up with television," he said.

Jeff Bewkes, Time Warner chairman and CEO, said Walton took over an underperforming company in 2003 and tripled earnings, delivering an annual growth of 15 percent. Roughly half of the company's earnings come through subscription fees from cable and satellite companies, and they have been growing steadily worldwide.

"Jim has been instrumental in growing the business into the financial powerhouse it has become, while establishing the brand as the worldwide leader for television news," Bewkes said. "I respect him personally and professionally and support the decision he and Phil Kent have reached."

Kent said Walton has a track record of great judgment when it matters most. He "challenged the organization to think bigger, reach further, do better," he said.

"I think this company needs some new thinking," Walton said. "I've been doing this job I'm in now for 10 years and I'm ready for a change."

The modeling of new enzymes helps develop therapies for cocaine abuse

Friday, July 27, 2012

Researchers from the University of Kentucky have designed and discovered a series of highly efficient enzymes that effectively metabolize cocaine. These high-activity cocaine-metabolizing enzymes could potentially prevent cocaine from producing physiological effects, and could aid in the treatment of drug dependency. The results of this study by Chang-Guo Zhan et al are published in the journal PLOS Computational Biology.

The effectiveness of the enzymes' work was evaluated through modeling cocaine pharmacokinetics, the study of the body's action on administered external substances, such as cocaine, when the enzyme exists in the body. As there is no FDA-approved anti-cocaine medication, the medical and social consequences of cocaine abuse have made the development of anti-cocaine medication a high priority. Administration of an enzyme to enhance cocaine metabolism has been recognized as a promising treatment strategy for overdose and abuse. A remarkable feature of the enzyme-based therapeutic approach is that one enzyme molecule can degrade many thousands of drug molecules per minute.

This pharmacokinetic modelling is a crucial step of enzyme-based therapy development for cocaine abuse. Furthermore, the general insights of the research should also be valuable for future development of an enzyme therapy for any addictive drug, as the general methodology of the modelling may be used to develop valuable models for evaluating the effectiveness of metabolic enzymes in detoxifying other drugs.

Sleek, Slippery, and Separate ? Choice in Dying

Philip Tartaglia, RC Archbishop elect of Glasgow

? one?may smile and smile, and be a villain.

Thanks to Haggis for the link to the story in the Scotsman. Here is Philip Tartaglia, archbishop-elect of Glasgow in the Roman Catholic Church, presently the bishop of Paisley. Nothing special about that and not really worthy of note at all, but his truly idiotic remark about the death of a Scottish MP is really beneath contempt. These guys think they have the right to speak on any pretext whatever, if it helps to get their regressive morality noticed. It should actually get him sued for libel, since he attributed David Cairn?s death to his gay lifestyle. According to the Scotsman report:

Philip Tartaglia?s suggestion prompted criticism from friends and the partner of the late David Cairns, a former priest, who claimed the Catholic leader had suggested the politician?s death at the age of 44 was somehow connected to his sexual orientation.

Tartaglia?s?comments were made in Oxford, where he was attending a conference on freedom and equality (of all things!). Asked to comment on the suicide death of a gay author in the United States, Tartaglia replied:

If what I have heard is true about the relationship between the physical and mental health of gay men, if it is true, then society is being very quiet about it,? the archbishop-elect, 61, said.

Recently in Scotland there was a gay Catholic MP who died at the age of 44 or so, and nobody said anything, and why his body should just shut down at that age? Obviously he could have had a disease that would have killed anybody. But you seem to hear so many stories about this kind of thing, but society won?t address it.?

Cairns, a Scottish MP, former Roman Catholic priest, and a devout Catholic, had lived in a committed relationship for fifteen years, was a?highly respected member of parliament, and a member of cabinet. He died of acute pancreatitis, and his death had nothing to do with his ?gay lifestyle.? That the new archbishop elect of Glasgow should have suggested a conspiracy of silence regarding the physical and mental health of gay men is the kind of innuendo one comes to expect of Catholic officials who, when unable to make an accusation stick, assassinate by suggestion rather than speak the truth. As Mr. Cairn?s partner said:

I don?t care what his views on gay marriage are, but to bring in my dead partner to justify those views is wrong.

Not just wrong, however. It was cruel and unnecessary, and unacceptable coming from a public figure. It was not, however, surprising, since the Catechism of the Catholic Church has normalised the practice of using unduly prejudicial language to speak about practices and relationships that the church finds morally questionable. At the same time it claims to receive and welcome with respect?those who are spoken of as gravely disordered.

It is worthwhile remarking that the cherubic faced archbishop elect will not get the last laugh, which is reserved for the Scottish Parliament, which has announced its intention to introduce legislation legalising same-sex marriage. According to the Scotsman, despite the fact that two-thirds of respondents opposed the measure (generated, one suspects, by the churches, who have weekly opportunities to harangue their charges), the Scottish National Party has announced that it will proceed with the legalisation, because it is ?the right thing to do.? In announcing the decision, Deputy First Minister Nicola Sturgeon has declared that

We are committed to a fair and equal Scotland.

Not surprisingly, of course,

[r]eligious leaders have dismissed the plans as a ?dangerous social experiment?, amid concern that it conflicts with? traditional doctrines that marriage is between a man and a woman.

But the move has been widely welcomed by campaigners and political leaders, with the first gay marriages likely to be held in Scotland by 2015.

Religion is simply on the wrong side of history, desperately holding its finger in the dyke of privilege and pontification, while all around it people are simply walking away in disgust. It is impossible to pry religion loose from the decaying remnants of another time, when clerical privilege justified practically any outrage?against humanity. But now the sleek, overfed virgin who is slated to take over the archdiocese of Glasgow, reminding one, for all the world, of Chaucer?s?Pardoner, simply cannot understand what ordinary people think and feel, but it makes no matter:

??let me briefly make my purpose plain;
I preach for nothing but for greed of gain
And thus I preach against the very vice
I make my living out of ? avarice.
And yet however guilty of that sin
Myself with others I have power to win
Them from it, I can bring them to repent;
But that is not my principal intent.
Covetousness is both the root and stuff
Of all I preach. That ought to be enough.

The Pardoner had just said:

The curse of avarice and cupidity
Is all my sermon, for it frees the pelf.
Out come the pence, especially for myself
For my exclusive purpose is to win
And not at all to castigate their sin.
Once dead what matter how their souls may fare?
They can go blackberrying for all I care!

Tartaglia has said that it was not his intention to offend, and though he has been asked to stand down, it is clear that he will not do so, saying that, despite his offending words, David Cairns was buried as a Catholic (although, it needs to be said, according to the church he was living in grave sin), and pastoral aid was offered to his family and friends.

Dermot Kehoe, David Cairn?s partner, will have none of this, and called for the bishop to resign. According to the Daily Record, Kehoe said:

It is beyond belief that a man of God can come out with something as ridiculous and hurtful as that. He is not fit for public office.

I would also like him to show some genuine contrition for what he said. Tartaglia now has no authority for moral leadership at all and he must resign.

I hope to God he never has to watch someone he loves lying in intensive care. It was horrific and traumatic.

David was my life. I was with him till the end. For two months before he died, I spent every day at David?s bedside hoping he would pull through as he slipped in and out of consciousness.

That is what I think relationships are about. We loved each other and were devoted to each other.

It is devastating enough to lose someone you love without people like Tartaglia coming out and trying to blacken his name. He has besmirched David?s memory by saying he died because of his choice of lifestyle and seeking to use this to influence the issue on equal marriage.

This is more than distressing for me and his family, it has caused us all a great deal of emotional and physical pain. It makes me very angry.

And so he should be ? angry that is. But what else are bishops to say, if their church is still mired in the Dark Ages, and are being chained there by the aging conservative in the Vatican, and, like the fabled king, commanding the tides of change to cease? A large number of Catholic lay people have said that Tartaglia does not speak for the church, but of course he does. Who do they think they are fooling? It?s high time people recognised that?celibate clergy ? if ever they could ??can no longer speak for ordinary people. They are too isolated from ordinary life to understand or to speak to their situation. The fiction that they are more able to serve, because not committed to a relationship, is contemptible. They cannot really serve, precisely because they lack the humanity that a committed relationship might provide them.

Summery touches to help you sell your home | Home Remodeling ...

In most markets, home sales tend to peak in spring and then remain strong through the summer months. In addition to heightened consumer demand, summer also offers sellers a chance to showcase their homes, drawing attention to attractive landscaping features that are hidden beneath a blanket of snow in the winter months.

If you?re looking to sell your home in the summer months, here are a few landscaping touches and backyard improvements that can make your home look more inviting and exciting to potential buyers.

Think of the Children

There?s a reason your realtor bakes a fresh batch of cookies before an open house. The key to selling a house is to make it?feel?like a home ? a warm, comfortable place where people can imagine raising a family and growing old.

To market your home to buyers with young families, you want to transform your yard into a place where kids can roam free and have fun. Something as simple as a treehouse, swing set or sandbox can offer that hook that makes a potential buyer stop and think, ?This is a place where I can raise a family.?

A Well Tended Garden

Poor landscaping is a common problem for sellers ? a once-promising flower garden has given way to weeds, and the lawn has lost its luster beneath the hot summer sun. But these are cheap and easy problems to fix. A little fertilizer and proper watering can get your lawn to look lush and green again. And an afternoon of weeding and a tray full of seedlings can bring that garden back from the brink.

If you plan on selling in a few years, adding a few trees can create an added sense of privacy and help a yard look more pleasant in the summer months. Cypress and poplar are particularly fast growing, allowing you to carve out a nice shady corner in just a few years? time.

Big-Ticket Items

Offer that hook that makes a potential buyer stop and think.

- Adam Verwymeren

?

A new wooden porch is one of the five best improvements that you can add to your home, according to?a study done by Realtor Magazine. Potential buyers love the thought of long summer nights spent entertaining family and friends on a nice porch, and this sort of addition can really give you an edge in a tight housing market.

Unfortunately you?re never going to recoup the full cost of a major renovation. For a porch, you?re probably going to get back about 70 percent of the original improvement price. So don?t bother building if you are looking to sell in the immediate future. However, if you?re thinking of selling in a few years and wouldn?t mind enjoying a nice, new porch in the meantime, go for it. It could really make a difference down the road.

Backyard Kitchens

While porches can claim the No. 5 spot on the top improvements list, remodeled kitchens come in at No. 3. If you want to cater to a growing foodie class lusting for a perfect culinary space, why not take the kitchen outside and add a few gourmet touches to your yard? By adding a few permanent fixtures like a backyard pizza oven, a bar built into the porch, or a brick barbecue, you offer potential buyers a place where they can dream of entertaining guests and wowing them with a fancy meal.

The Small Stuff

Most homeowners have a long list of neglected chores that they never seem to get around to completing. But if you are looking to sell, it?s time to sweat the small stuff. After you?ve cleaned up the yard, ask yourself, are there other, bigger problems with your yard that might be a turn-off to potential buyers? Rotted out tree stumps, dangling gutters, overgrown bushes or poor drainage that causes water to pool after a heavy rain are all things that can make a buyer think twice about your home. So before you try to sell your home, tackle your to-do list.

Hispanics feel harassed under Alabamas immigration law | Round ...

July 21, 2012
By Alan Gomez

When Natividad Gonzalez?s 3-year-old daughter fell off the stairs at their home in Maplesville, Ala., the panicked mother raced to the local hospital.

She carried her daughter into the emergency room and scanned the room for help, but came to halt when a doctor approached them.

?Instead of asking me what happened to my daughter, he asked me what her (immigration) status is,? said Gonzalez, 27, who emigrated from Mexico illegally nine years ago, but gave birth to her daughter in the United States, making the child a U.S. citizen. ?People think that doesn?t really happen. They say the new immigration law won?t affect people who are legal. But that?s wrong.?

By Seth Borenstein,?Associated Press / July 24, 2012

Measurements from three satellites showed that on July 8 (right) about 40 percent of the ice sheet had undergone thawing at or near the surface. In just a few days (July 12), an estimated 97 percent of the ice sheet surface had thawed. The areas classified as ?probable melt? NASA says the melting area went from 40 percent of the ice sheet to 97 percent. Until now, the most extensive melt seen by satellites in the past 30 years was about 55 percent.

Scientists cannot say yet if the melting is from global warming or natural.
